Private Party Agreement

EVENT PROGRAM: PaintPartyLife.com events are uniquely entertaining, easy to follow, 1.5 to 2 hour, group painting lessons taught step-by-step by local professionals. Included in our event pricing are your personal event coordinator, painting instructor, and all materials needed to complete your very own acrylic masterpieces (except for tables and chairs). By moving forward with booking your party, you are agreeing to these and the following basic terms and conditions. 

PAINTING SELECTION: After officially booking your party, you will be sent a link to our paintings gallery for your review and selection. Our gallery may also be viewed anytime online: PaintPartyLife.com/gallery2. You may also request a custom painting for your party for an additional one-time $75.00 fee (1 revision if necessary per order). Custom paintings are non-refundable. The artist may only instruct one design per 2-hour party. Please select your painting option within 48 hours of booking.

 

DEPOSIT: In order to officially book your date and begin the coordinating process, we require a deposit amount equal to just the first 3 seats (in some cases, the first 4 to 5 seats). We do not save or hold spots.* The deposit must be received before your event will be considered "booked”. All dates and times are subject to availability and are strictly booked on a first-come, first-served basis. 

PROMOTIONS: We advertise multiple promotions and run various sales throughout the year; official offers/promotions that are generated by our company (vs. a third-party platform such as Groupon or Living Social) will always have governing rules and limitations which may be found and reviewed at any time under our Terms and Conditions page or (here) in the Private Party Agreement portion of our website. PaintPartyLife.Com reserves the right to revoke or refuse service at any time as our team members deem fit or necessary. All prices, promotions, and regulations are subject to change without notice. Complementary Seats* Currently, we offer several promotions that advertise complimentary seats. Free seats are applicable only after the minimum number of attendees required for your party has been met. Limit 1 coupon per party - other rules may apply. 


PAYMENT METHOD: All major credit cards, including AmEx, will be accepted. Upon successful completion of payment, a purchase confirmation/receipt will immediately be sent to the cardholder’s email address directly from Authorize.net, our eCommerce platform provider. All transactions are made either, over the phone with a PaintPartyLife.com representative, or via the private event payment link provided to you upon booking. We do not accept cash, and checks are accepted only under specific circumstances. Gratuity* tipping your artist(s) is optional.

EVENT START TIME: Our artists have a strict schedule to maintain. They must begin the painting portion of your party on time in order to complete the lesson successfully in the two hours allotted. Your Event Host/Painting Instructor will arrive (30) thirty minutes to (1) one hour prior to the agreed start time to begin setting up, barring any emergency traffic situations. Delays and late arrivals* We are not responsible for attendees who arrive later than 15 minutes regarding the full completion of their painting. All parties are 1.5 to 2 hours long and will not be extended due to significant start time delays on part of the host or guests. If your party begins late, it must still end at the agreed-upon time. In order to avoid this situation, and for things to run as smoothly as possible, please plan ahead with your guests.

TIME EXTENSIONS: Time extensions for your party may be requested up to 3 days before your party in increments of 1 hour at a fixed rate of $75 per additional hour. However, this will not be an available option on the day of your event.

FINAL PAYMENT:  Guest registration for your party will close 3 days prior to your scheduled event date at 2:00 p.m. sharp. You may use the following link (or the link you were provided) to either have your guests register individually or simply pay for them all at once: http://bit.ly/2x7ENxb. An exact final headcount of your attendees, along with full payment(s) (via authorized credit card transaction), will be due in full no later than 2:00 p.m. 3 days prior to your scheduled event. Our artists will not receive any form of payment on the day of your event. Our office will attempt two phone calls to the number on file for information and payment collection. If we do not hear from you by the aforementioned deadline and have not received your final payment, PaintPartyLife.com reserves the right to consider your event subject to cancellation without notice. Additional supplies*: Due to the large number of events running simultaneously on any given day, we cannot guarantee seating for those joining day-of. In order for things to run smoothly, please plan ahead with your guests and provide your final headcount (along with payment) by 2:00 p.m. 3 days prior to your scheduled party. *Our artists pack supplies according to your final headcount. They do not pack supplies for extra attendees*. 

REFUNDS AND CANCELLATIONS: Our required deposit for most events is equal to the first 2 to 5 seats (depending on the current promotion) and is 100% refundable if canceled within 48 hours of the purchase date. As a courtesy, event dates and times may be postponed/rescheduled at no charge a maximum of (1) time within this period (provided that your new event date/time is submitted immediately); any seats canceled after this time will NOT be eligible for a refund. Note* Refund requests made post-party due to a major service disagreement must be submitted no later than 24 hours after the event in order to receive proper consideration; after this time, no refunds or credits will be available. Under no circumstances do we offer 100% refunds.  All cancellations and/or complaints must be submitted in writing. Email your event coordinator at hosts@paintpartylife.com

 

Postponing/Rescheduling *: Requests for postponement/rescheduling (this includes time and/or date changes) made 48 hours after the purchase date will be subject to a $10.00 processing fee (charged at company's discretion to the card on file or via payment link sent to host). Your new event date/time must be submitted within 24 hours of the postponement/rescheduling request. If we do not hear from you for more than 7 business days, your event will be automatically dropped and the deposit forfeited. All event dates are subject to availability. Any member of your party with pre-purchased seats who wishes to cancel their reservation as a result of host's postponement/cancellation will be granted their refund minus a $5.00 per seat refund processing fee. Upon request, host may choose to absorb this fee on their behalf. Cancellation*: All cancellations by your party must be received in writing and with at least 3 days advance notice. In the event of a cancellation, email your event coordinator at hosts@paintpartylife.com. Forfeited deposits may not be used at a later date toward another event. If a party is a "no show," all final charges will be kept. Any individual member(s) of your party with pre-purchased seats who do not attend the event will also not be eligible for a refund. Minimums and Additional Charges*: All of our private party promotions have a minimum number of attendees that need to be met. Host is solely responsible for any additional amount(s) should the final headcount fall under the required minimum number. As a reminder, our artists do not accept payments or provide change - for safety reasons. All payments are made online or over the phone via our head office at (321) 384-1047.

PRIVACY | We at PaintPartyLife.Com value our customer's privacy and will not share your email address or any personal information with anyone outside of our organization. We use a secure credit card payment system for your (and our) security. With your permission, we will send you emails about special events and upcoming special events you might be interested in. If you no longer want to receive our promotional announcements, simply email events@paintpartylife.com and ask to be removed from future correspondence.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT (the “Release”) WARNING: BY MOVING FORWARD WITH BOOKING AN EVENT, YOU (the "Host") GIVE UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY BEFORE MOVING FORWARD. THE HOST OR BOOKING AGENT MUST BE 21 OR OLDER.

Intending to be legally bound, Host hereby certifies that: 1.) Host is 21 years of age or older. 2.) Host understands that by moving forward with this Release in connection with his/her participation in an event organized by Paint Party Life, LLC (hereinafter referred to as “Paint Party Life”), which consists in private paint parties in which alcohol may be served and consumed (the “Painting Event”). 3.) Host is submitting this Release voluntarily and of their own free will. 4.) Host understands that He/She is assuming certain risks by participating in the Painting Event and that is giving away certain rights by moving forward with this Release DISCLAIMER CLAUSE Paint Party Life and its employees, subsidiaries, affiliates, agents, representatives, assigns, directors, owners, members, managers, and assigns, (and any related volunteers, sponsors, organizers, or other persons in privity with Paint Party Life in relation to the Painting Event) (collectively referred to as the “Released Parties”)_are not responsible for any injury, loss, or damage of any kind sustained by any person while participating in the Painting Event or related activities, including injury, loss, or damage which might be caused by the action, inaction, or negligence of the Released Parties, or any other persons or participants. You hereby, for yourself, your heirs, executors, administrators, or anyone else who might bring a claim on your behalf, covenant not to sue, and waive, release, and discharge the Released Parties of any and all claims of liability for death, personal injury or property damage of any kind or nature whatsoever arising out of, or in the course of my participation in this Painting Event. This Release extends to all claims of every kind or nature whatsoever, foreseen or unforeseen, direct or indirect, known or unknown. You hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this Painting Activity. You understand while participating in this Painting Activity, you may be photographed. You agree to allow your photo, video, or film likeness to be used for any legitimate purpose by Paint Party or the activity holders, producers, sponsors, organizers and assigns. ASSUMPTION OF RISKS In consideration of your participation in the Painting Event and related activities, you acknowledge that you are aware of the possible risks, dangers, and hazards associated with your participation in the Painting Event and related activities (including the risk of severe or fatal injury to myself or others). These risks include but are not limited to the following: 1. The risks associated with travel to and from the Painting Event location(s), including transportation provided by commercial, private, and/or public motor vehicles; 2. Intoxication and/or alcohol poisoning from the alcohol I consume, whether voluntarily or through coercion, while participating in the Painting Event; 3. The possibility of bodily injury of any kind, including dental damages, from (including but not limited to): (a) slipping and/or falling down; (b) entering or exiting the mode of transportation being used to attend the Painting Event; and (c) being knocked down or being involved in a physical confrontation whether caused by myself or someone else whether inside or outside the Painting Event location; (d) getting cut with glasses or suffering any other injury due to the use and exposure to paint or other chemicals used for painting; (e) suffering injury by any tools or materials falling down, etc; 4. The risks associated with returning to my residence after participating in the Painting Event, whether traveling by foot or in any kind of commercial, private, and/or public motor vehicle. INDEMNIFICATION AND RELEASE OF LIABILITY In return for my voluntary participation in the Painting Event and related activities, you agree: 1. TO ASSUME AND ACCEPT ALL RISKS arising out of, associated with, or related to your participating in the Painting Event, even though such risks may have been caused by the action(s), inaction, or negligence of the Released Parties, or any other persons or participants. 2. TO BE SOLELY RESPONSIBLE FOR ANY INJURY, SOCIAL AND ECONOMIC LOSS, COST, OR DAMAGE which you might sustain while participating in the Painting Event even though such injury, loss, or damage may have been caused by the action(s), inaction, or negligence of the Released Parties, or any other persons or participants. 3. TO HOLD HARMLESS AND INDEMNIFY the Released Parties to the fullest extent permitted by law, from: a) any and all liability for any damage to the personal property of, or personal injury to, any third party resulting from your participation in the Painting Event and other related activities; and b) from any and all claims, demands, actions, losses, and costs which might arise out of your participating in the Painting Event, even though such claims, demands, actions, losses, and costs may have been caused by the action(s), inaction, or negligence of the Released Parties, or any other persons or participants. As a participant in the Painting Event organized by Paint Party Life, LLC, you acknowledge that: (a) you have read and fully understand the terms of this Release; (b) you understand that this Release is to be binding upon yourself, your heirs, executors, administrators and representatives, in the event of your death or incapacity. (c)  you intend this Release to be a complete and unconditional release of all liability to the greatest extent allowed by law; (d) you understand that you have given up substantial rights by moving forward with booking (e) you have executed this Release voluntarily and without any inducement or assurance of any nature.
